In 1992, after Ross Perot was included in a presidential debate along with the Republican President George H.W. Bush and the Democratic nominee Bill Clinton, three out of the four polls taken immediately after the debate found that Perot “won” the debate in the eyes of voters.
Many analysts at the time -- and since -- attribute those poll results to the fact that, unlike the Republican and Democrat, Perot spoke frankly about key issues of the day, especially the need for a balanced budget.
In 2012, when Barack Obama and Mitt Romney debated, it was very difficult to find any issues on which their differences were anything more than matters of degree. Nowhere was there a plan or a commitment to achieve a balanced budget. Nowhere was there a debate over the fundamental wisdom of military interventions, the growing surveillance state, or real tax reform.
Like 1992, the participation of other candidates, such as myself, would have forced a real discussion of real issues.
The only reason I was not included in the 2012 presidential debates is that the Republicans and Democrats didn’t want me on the stage, and didn’t want the issues raised that I would have raised. It’s that simple.
The Commission on Presidential Debates -- created and controlled by the two “major” parties -- uses an arbitrary polling threshold to exclude any candidates other than the Republican and the Democrat.
At a time when a majority of Americans believe that neither the Republican nor the Democratic Party represents them, this is an outrage.
That’s why the Our America Initiative is coordinating the filing of a lawsuit in federal court in Washington, DC, to challenge the exclusionary and monopolistic practices of the Commission on Presidential Debates. Fairness -- and the critical need to change the dialogue about key issues -- demands that the debates be changed, and we are stepping up to force that change.
Over the past several months, we have worked diligently to assemble the appropriate set of plaintiffs: Libertarian vice-presidential nominee Jim Gray, the Libertarian Party, the 2012 nominees of the Green Party (who also qualified for sufficient states’ ballots to potentially garner a majority in the Electoral College), the Green Party -- and myself.
We have also assembled a nationally-recognized legal team who will handle the litigation: Rocky Anderson, former Salt Lake City mayor, presidential candidate and respected public interest attorney, and by Bruce Fein, a nationally-known constitutional lawyer who served as Associate Deputy Attorney General and General Counsel of the Federal Communications Commission under President Reagan.
The complaint that will be filed in a few short weeks has been drafted, subject to fine-tuning and review by the various plaintiffs. The research has been largely completed, and we are ready to do battle.
With this groundwork laid, it is now essential that we bring key supporters and advocates such as you into the effort. Our America cannot fight this fight without the help, and frankly, the funding that you can help bring to the table. These invitation-only meetings will begin that conversation. Members of our legal team and I will share our strategy, our legal arguments and the budget -- and seek your counsel, input and support.
